By installing, accessing, or using the Service, you ("Merchant," "you," or "your") agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.
Bamzal is a Shopify embedded application that provides AI-powered multi-channel ad campaign creation and management services across Google Ads, Meta (Facebook & Instagram), TikTok Ads, Pinterest Ads and X Ads. The Service includes:

To create campaigns through the Service, you must additionally connect your own Google Ads, Meta (Facebook & Instagram), TikTok Ads and/or Pinterest Ads account via each platform's official OAuth 2.0 authentication (including Facebook Login for Business for Meta). Bamzal operates as a Tech Provider acting on behalf of the business clients who authorize such access.
You retain full ownership and control of your Google Ads, Meta, TikTok and Pinterest ad accounts at all times. Specifically:

The Service, including its design, features, code, and branding, is the intellectual property of Bamzal Ltd. and is protected by copyright and other intellectual property laws.
AI-generated ad copy created through the Service may be freely used by you for advertising purposes. We do not claim ownership of ad copy generated for your products.
Our collection, use, and protection of your data is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the data practices described in our Privacy Policy.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SMART ADS AI LTD. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You understand that your advertising spend on Google Ads, Meta (Facebook & Instagram), TikTok Ads, Pinterest Ads and X Ads is paid directly to each respective platform, and that we are not responsible for any advertising costs incurred in your Google, Meta, TikTok or Pinterest ad accounts, including those resulting from campaigns created through our Service that you have approved and enabled.
You agree to indemnify and hold harmless Bamzal Ltd. and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any Google Ads, Meta (Facebook & Instagram), TikTok Ads or Pinterest Ads policies; or (d) any advertising content you approve and publish through the Service.
You may terminate your use of the Service at any time by uninstalling the Shopify app. We may suspend or terminate your access to the Service if you violate these Terms, with notice when practicable.
Upon termination:
We reserve the right to modify these Terms at any time. Material changes will be communicated by posting the updated Terms on our website and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the modified Terms.
These Terms shall be governed by and construed in accordance with the laws of the State of Israel, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts located in Israel.
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Bamzal Ltd. regarding the use of the Service.
